J.S. Mackenzie surveys Western philosophy from Socrates to the New Realists in an uncomplicated and approachable style. Originally published in 1917, this text serves as a useful introduction to philosophy and well-summarises the key theories of great philosophers throughout the centuries and their bearing on early twentieth-century thought. It is ideal for students of Philosophy, both for beginners and the more advanced.

They met in 1920 and for some years nurtured hopes of a cooperative renewal of Western philosophy. In June of 1921 Heidegger sent Jaspers a lengthy criticism of his Psychologie der Weltanschauungen, but Jaspers neither read it fully nor took it seriously, and thereby no doubt miffed Heidegger. When reports reached Heidelberg that the younger man was criticizing him behind his back, Jaspers confronted Heidegger and received both a categorial denial and protestations of "der alles tragende Glaube in der (...) Liebe". Apart from Heidegger’s 1921 effort, they apparently neither read nor understood each other’s work during the time of their relationship. Then everything fell apart in 1933. Perhaps there was already some tension between their wives, something never to be discounted in philosophical circles. And even though Jaspers never took Heidegger for an anti-Semite, and although he warmly congratulated him on the inaugural address as rector of Freiburg, he was shocked at Heidegger’s naïveté about Hitler and the future. They last saw each other in June of 1933, and thereafter Jaspers received damning evidence of the extent of Heidegger’s compromise. He read a copy of a 1933 letter in which Heidegger would have a certain Mr. Baumgarten excluded both from the Nazi S.A. and from teaching, due to his origins in "the liberal-democratic circle of Heidelberg intellectuals around Max Weber" and because of his association with "the Jew Frankel". Later, in 1937-38 he heard that Heidegger maintained the no longer obligatory Hitler salute before lectures. After 1936 correspondence between them ceased, but Heidegger continued sending Jaspers his publications and in 1945 requested from him a letter of support to the Freiburg commission that would decide Heidegger’s post-war academic fate. Jaspers’s letter mentioned the Baumgarten affair and said that Heidegger’s 1933 capitulation seemed to justify excluding him from teaching, but that he should have every freedom to continue his research. Nietzsche’s encounter with Socrates is examined in all of the relevant passages in the former’s writings. Dannhauser depicts this encounter as a quarrel between a modern and an ancient that runs through all the stages of Nietzsche’s intellectual development. The ambiguous, not to say ambivalent, nature of Nietzsche’s "view" of Socrates as a man and thinker is carefully shown even though it does not appear that any depth interpretation of this issue actually emerges. It is pointed out that, for the (...) most part, Nietzsche sees Socrates as a turning-point in Western history, as the arch-rationalist, the dialectician who advocates the supremacy of morality over all else, a decadent personality, and the enemy of instinctive life. What can the actions of stockbreeders, as they select the best individuals for breeding, teach us about how new species of wild animals and plants come into being? Charles Darwin raised this question in his famous, even notorious, Origin of Species (1859). Darwin's answer - his argument by analogy from artificial to natural selection - is the subject of our book. We aim to clarify what kind of argument it is, how it works, and why Darwin gave it such prominence. (...) As we explain more fully in our Introduction, we believe that the argument becomes much more intelligible when set, contextually, in a story stretching from classical Greek mathematics to modern evolutionary genetics: a long story, and a broad one too, encompassing everything from Darwin's earliest notebook theorising on the births and deaths of species, to agrarian capitalism as a distinctive form of economic life, to shifting Western reflections on art-nature relations. From a global historical viewpoint, federal systems are the exception rather than the rule, even though examples of federalism can already be found in Greek antiquity. From the 17th century onwards there was a revival of federalism, but in the post-World War II-era of decolonization federal systems did not emerge as the most popular form of government.Still, there is considerable variation among federal systems, i.e. those political systems where governmental authority is constitutionally divided among a central «federal» government and «state» (...) governments in such a way, that each type of government has final decision-making authority in at least a few policy fields ; a federation may be either effective or formal, unitary or decentralized, symmetrical or asymmetrical. In order to explain the extent and the kind of federalism in specific cases, the formallegal structure, the socio-economic environment and the political behaviour of elites as well as citizens should be taken into account. Political behaviour should be taken as the key factor, without disregard, however, for its relationship to social factors and format structures. In order to assess their relative importance, comparative research is required; Western Europe and the Third World offer highly promising prospects for this type of research. On the research agenda of federalism, special attention should be given to topics like the informal federal arrangements in cabinet formation, policy-making and public administration, federal party polities, and the impact of public policies on the federal socio-economic environment. There are more philosophy teachers alive today than existed from Socrates until 1900, and this year alone there will be more "contact hours" in philosophical wisdom than in the two millenia before Descartes. One might legitimately wonder what is done with all that time and why the world is not immensely better for it. The first, if not the second, of these questions is addressed and answered in this serious, thorough and much-needed collection of essays. Eduard Fey, founder and long (...) the president of the International Society for Teachers of Philosophy, and a dozen coworkers have surveyed the historical background and present-day structure of philosophical instruction in every country of Western Europe—in sixteen essays, some as long as fifty pages, some as brief as five pages. The volume is thorough. One can learn, for example, exactly what a gymnasium senior in Luxembourg studies during his weekly three hours of philosophy. One can learn how Hans Richert tried to reform high school instruction in Germany in 1925, only to be opposed by the Catholic hierarchy’s insistence that metaphysical questions be treated only in religious instruction, or how the German Idealist Krause influenced Spanish pedagogy through his student Julian Sanz del Rio, and so on. Given the range and detail of the material, the lack of an index to the volume is keenly felt. (shrink)

Assuming that one believes that individuals and states can morally defend values, beliefs, and institutions with force , one logically wants just combatants to possess the physical, mental, and spiritual capacities that will enable them to win the war. On the other hand, being a just combatant in a just war does not morally entitle that combatant to do anything to win that war. The moral requirement for just combatants to fight justly is codified in international law of war and (...) in state-specific legal documents such as the United States Uniform Code of Military Justice. While it is almost unequivocally clear to soldiers and civilians who soldiers cannot harm in the performance of their duties, and why these people are exempt from harm, it is less clear what the state itself can morally do to its own soldiers to enhance their chances of victory: can the state do anything to soldiers to give them an advantage on the field of battle?For United States soldiers and their counterparts in most Western liberal democracies, the answer is obviously no. Deeply embedded social and cultural norms in Western democracies mandate that the state set and enforce rigid lines which drill sergeants and earnest commanders cannot cross, even in the name of combat readiness, grounding these norms in notion of basic rights appealed to in the U.S. Constitution. In this essay, I argue against some types of drug-induced internal biotechnical enhancement of soldiers on the grounds that, in the present state of technology, it is not reasonable to suppose that the military can perform such enhancement operations on soldiers without causing irrevocable psychological damage that would certainly and unjustifiably alienate the soldiers from the very society they serve. There are good reasons for envisioning a global discourse about God, premised necessarily agreed upon perfections considered to be by definition proper to God, and for thinking through the implications of our understanding of God for morality. Philosophically, it makes sense to hold that claims about omnipotence, omniscience, and other superlative perfections are indeed maximal, and define “God” wherever the terminology of divine persons is taken up. Religiously too, it makes sense to assert that a deity possessed of perfections is (...) not just the deity of one’s own tribe or religion, but also the deity of the whole world, whether acknowledged as such or not. This essay delves into the larger set of rich complexities by three moves. First, I look into a single extended historical case of the extension of the discourse about God beyond the Christian West, the discourse on God proffered by Western Jesuit missionaries in India from the sixteenth to twentieth centuries. Second, I place next to that Jesuit learning the instance of a famed Hindu theologian’s discourse on God, God’s perfections, and their moral implications. Third, I briefly step back and assess the dangers and fruitful prospects inherent in thinking about God and morality in an interreligious context. (shrink)

This article surveys western business ethics' recent history to show how this ethic has neglected recently its religious traditions and become construed more narrowly as an applied philosophy and social science. It argues that this narrowness has confused business ethics' role in business education and helped to weaken the distinctiveness of certain institutions of higher education. It then suggests ways that western business ethics might become more integrated, interesting, and autonomous as an academic discipline by incorporating its key (...) religious traditions. (shrink)

Located at the crossroads of the Eastern and Western world, Turkey today is characterized by a demographically versatile and modernizing society as well as a rapidly developing economy. Currently, the country is negotiating its accession to the European Union. This article yields some factual grounding into the ongoing value-related debate concerning Turkey's potential EU-membership. It describes a mixed-methodology study on moral reasoning in Austria and Turkey. In this study, the arguments given by individuals when evaluating ethically problematic situations in (...) business were compared. Although there were major consistencies, a number of differences were found. These differences, however, were not in the substance of arguments used but in their relative frequency. Overall, our findings suggest that young, well-educated urban individuals from Western Christian and Eastern Islamic countries are highly consistent in their moral reasoning. (shrink)

The foreskin is a complex structure that protects and moisturizes the head of the penis, and, being the most densely innervated and sensitive portion of the penis, is essential to providing the complete sexual response. Circumcision—the removal of this structure—is non-therapeutic, painful, irreversible surgery that also risks serious physical injury, psychological sequelae, and death. Men rarely volunteer for it, and increasingly circumcised men are expressing their resentment about it.Circumcision is usually performed for religious, cultural and personal reasons. Early claims about (...) its medical benefits have been proven false. The American Academy of Pediatrics and the Centers for Disease Prevention and Control have made many scientifically untenable claims promoting circumcision that run counter to the consensus of Western medical organizations.Circumcision violates the cardinal principles of medical ethics, to respect autonomy, to do good, to do no harm, and to be just. Without a clear medical indication, circumcision must be deferred until the child can provide his own fully informed consent.In 2012, a German court held that circumcision constitutes criminal assault. Under existing United States law and international human rights declarations as well, circumcision already violates boys› absolute rights to equal protection, bodily integrity, autonomy, and freedom to choose their own religion. A physician has a legal duty to protect children from unnecessary interventions. Physicians who obtain parental permission through spurious claims or omissions, or rely on the American Academy of Pediatrics' position, also risk liability for misleading parents about circumcision. The idea that the self is inextricably intertwined with the rest of the world—the “oneness hypothesis”—can be found in many of the world’s philosophical and religious traditions. Oneness provides ways to imagine and achieve a more expansive conception of the self as fundamentally connected with other people, creatures, and things. Such views present profound challenges to Western hyperindividualism and its excessive concern with self-interest and tendency toward self-centered behavior. This anthology presents a wide-ranging, interdisciplinary exploration of the nature and (...) implications of the oneness hypothesis. While fundamentally inspired by East and South Asian traditions, in which such a view often is critical to philosophical approach, this collection draws upon religion, psychology, and Western philosophy, as well as sociology, evolutionary theory, and cognitive neuroscience. Contributors trace the oneness hypothesis through the works of East Asian and Western thinkers and traditions, including Confucianism. Mohism, Daoism, Buddhism, Platonism, Zhuangzi, Kant, James, and Dewey. They intervene in debates over ethics, cultural difference, identity, group solidarity, and the positive and negative implications of metaphors of organic unity. Challenging dominant traditional views that presume the proper scope of the mind stops at the boundaries of the skin and skull, The Oneness Hypothesis shows that a more relational conception of the self is not only consistent with contemporary science but has the potential to lead to greater happiness and well-being for both individuals and the larger wholes of which they are parts. Many traditional Mahayana, and modern Tibetan, Buddhist texts relate meditation attainment to psychic ability. This teaching served as the hypothesis—that more advanced meditators would choose a psi target correctly, significantly more often than beginners. A basic free-response design was used in which a computer programme (PreCOG) chose a target picture at random from a 4-picture set. There were 25 sets, all pictures of Tibet. PreCOG guided the participants through the procedure, in which they aimed to become aware of the target. (...) 18 participants, Tibetan monks, nuns and Western Buddhist meditators, completed 8 sessions each. Half the sessions used a clairvoyance, and half a precognition, protocol. Age and years of meditation practice correlated significantly with the psi scores (Pearson r = 0.52, p < 0.05). This suggests that, as one practices meditation, psychic awareness begins to manifest more reliably. This result was confounded by a non-significant psi-missing trend. There was no significant difference between the clairvoyance and precognition trials (t-diff (142) = 0.800). There was, however, significant psi-missing from the group of Rinpoches (t = -2.09, 2tail p < 0.05). The three participants who scored most strongly in the psi-missing direction all reported childhood memories of previous lives as monks in Tibet. Boston College April 2002 Iwill arrange my comments under four headings: (1) what we had hoped to accomplish; (2) what we actually did accomplish; (3) what we may have learned from this; (4) what this might now enable us to do in thefuture. This epilogueisbeingwritten in April, 2002,twenty-twomonths after the conference. To draw what good we can from this delay, writing at this distance (...) allows me to summarize and draw conclusions with, perhaps, a bit more balance. On the other hand, my listening again to the audio record in the course ofpreparing this publication has enabled me to relive something of the original experience. (1)As I indicated in the introduction, we had unrealistically hoped that, by the time ofthe conference, the five presenters, and perhaps also the twoprincipals inthe "Girard-Lonergan Conversation," wouldhavealready exchanged with each other not just first drafts, but even second drafts of their papers, and that the conference itself would then be invited to join a conversation that was already well under way. As it turned out, I couldn't muster the organizational skills and resources needed to achieve this. But reflecting after the fact, I can see that so carefully detailed a preparation might have been counterproductive. Carrying out our original plan might have been at the cost ofimposing more ofa Western analytic pattern on our discussion ofother traditions, and of!thus smothering from the outset some of the insight that did occur. We had also hoped that the opening "Girard-Lonergan Conversation" would provide an analytic resource for the rest of the meeting. But that did not happen to any great extent. (2)The proximate preparation for this conference began with a draft version ofmy paper being sent to the other major presenters. I opened with 194Robert J. Daly, SJ. a series of brief sketches of salient points in the often unhappy but also occasionally felicitous history ofChristianity on this theme ofviolence and institution. Then, after emphasizing the importance of distinguishing between the normative and the descriptive, I tried to make some sense, both rational and theological, of all this data, especially by reflecting on the influences and consequences ofthe belief in hell, on the one hand, and the hope of universal salvation, on the other. The next major religious theme was Judaism. Reuven Kimelman provided a detailed—and, for some, overwhelming—glimpse of the way the talmudic traditions deal with the theme of war and its restrictions. This highly text-oriented and interpretation-of-texts driven presentation seemed to many, at first, to be irrelevant to mimetic theory and to the need to be confronting actual violence. But, in the course of Sandor Goodhart's response, and in the course ofthe at times spirited discussion that followed, we began to understand that how one interprets texts and traditions, and how these are played off against each other, is indeed fundamental to the way Jews typically try to deal with the practical challenges of violence. Qamar-ul Huda's presentation on IsIamfocused stronglyonthe way the spiritual teachings of Islam—i.e., islam as a religion rather than Islam as a political or national institution—foster peace. The initial reaction was somewhat similarto the reaction to Kimelman's paper: disappointment that Huda was not talking more directly about contemporary Muslim extremist violence. But here, too, the discussion enabled us to catch a glimpse both of the inner spiritual resources of Islam, and of the limitations ofthe range of concerns that Westerners typically bring to the table. Francis Clooney, in his presentation ofHinduism, strongly emphasized the great variety in Hinduism, stressing that one cannot speak ofHinduism as such. Much of this variety comes from the several millennia of Hindu history, and from the complex relationships to Buddhism and Jainism which, themselves, are important parts of Hindu history, and also from the fact that only recently have Hindus, after centuries of Moslem or Colonial domination, once again returned to positions of political and military power. Finally, Christopher Ives's presentation on Buddhism, in a way similar to my presentation on Christianity, but more extensively or more consequently, pointed out the various ways in which Buddhism has been politically and... The ‘death’ of German Idealism has been decried innumerable times since its revolutionary inception, whether it be by the 19th-century critique of Western metaphysics, phenomenology, contemporary French philosophy, or analytic philosophy. Yet in the face of two hundred years of sustained, extremely rigorous attempts to leave behind its legacy, German Idealism has resisted its philosophical death sentence. For this exact reason it is timely ask: What remains of German Idealism? In what ways does its fundamental concepts and texts still (...) speak to us? This is a learned and informative study in ancient philosophy of mind and in ancient ethics and religious practice. It consists of two parts. Chapters 1-8 are a study in ancient philosophy of mind, and in particular in ancient views about the mental or psychological capacities of animals. Sorabji begins with the claims of Aristotle and the Stoics that animals do not have reason or belief. This denial of reason and belief to animals led Aristotle and the Stoics to reexamine (...) such psychological capacities as perception, perceptual appearance, belief, concept-possession, memory, intention, preparation, anger and other emotions, and speech. Sorabji also shows how Pythagoreans, Platonists, and some of Aristotle’s successors, such as Theophrastus, contested the Aristotelian and Stoic denial of reason to animals. Aristotle’s interests in these matters were mainly scientific, but for the Stoics and for their opponents the question about animal rationality raised religious and ethical issues, which Sorabji explores in chapters 9-15. He surveys Stoic, Epicurean, Neoplatonist, and Christian discussions of the treatment of animals, and in particular of the eating of meat and of animal sacrifice. He finds that the moral status of animals and their claims on humans were the matter of a serious and extended debate in pagan philosophy, a debate that has been largely overlooked ever since Western Christianity accepted the Stoic denial of reason to animals and its supposed consequence, the denial that animals have any claims on humans. Sorabji finds the Aristotelian and Stoic arguments against animal rationality less than persuasive, but his more substantive philosophical contention is that even if these arguments worked they would not be relevant to the moral issue of how humans should treat animals; what is relevant is that animals can feel pain. This study examined individual difference characteristics as predictors of business students’ attitudes toward sustainable business practices. Three types of predictors were considered: personal values, individualism–collectivism, and leadership styles. Data were collected from 248 business students attending a mid-sized university in western United States using self-reported questionnaires. Few gender differences were present. Hierarchical regression analyses, controlling for personal demographic characteristics, indicated that business students scoring higher on Rokeach’s social value scale, collectivism, and transformational leadership also reported more positive attitudes toward (...) sustainable business practices. Strand S.J.Is the political future of the West a postliberal one? For the past decade, numerous prominent thinkers in America and Europe have been debating this question. Matters that not long ago were merely of historical interest, such as Pope Gelasius I's understanding of the relation between sacral authority and royal power, Thomas Aquinas's thought on monarchy and (...) Robert Bellarmine's theory of the pope's indirect authority in temporal matters are now increasingly studied for their potential answers to contemporary political questions. This development, which would have been nearly unimaginable just a decade earlier, unsurprisingly has been led by Catholics. We say "unsurprisingly" in view of the long pre-modern tradition of Catholic political thought, as well as the Church's long struggle against liberalism during the nineteenth and early twentieth centuries. Some of the current postliberal writers explicitly connect themselves to both of these aspects by using the term "integralist" to describe their position.1 [End Page 889]This "new integralism" represents a radical departure from the mainstream of Catholic political discourse of the last half century, which has largely sought rapprochement with Western liberalism. A group of writers, led by John Courtney Murray, George Weigel, Michael Novak, and Robert George, have held that the American constitutional order is rooted in the natural law tradition, and therefore is basically friendly to Catholic political thought. The Church's role in American life, they say, is upholding the natural law as a public moral philosophy, while embracing the non-establishment clause of the First Amendment as a matter of principle, in accordance with the teachings of the Second Vatican Council. This "Whig Thomism," which for decades represented the predominant outlook of conservative American Catholics, must now face the challenge of a different sort of Thomism represented by the integralists.2While the engagement between Whig Thomists and integralists has received most of the attention from scholars and journalists alike, another postliberal option has emerged in recent years. Its source is a group of Catholic thinkers associated with the Communio theological movement. Their political vision, which has no single name or label, has a complex and subtle relationship with the thought of earlier Communio writers, most of whom shared the Whig Thomist desire for reconciliation with Western liberalism. [End Page 890] The appearance of a Communio postliberalism therefore represents a significant development within this intellectual tradition. The most important representative of the earlier Communio perspective on political questions is Joseph Ratzinger / Pope Benedict XVI, who has recently been lauded as the "most important Catholic thinker of the twentieth century" on matters at the intersection of theology and politics.3In an article titled "Ratzinger's Republic" that appeared in these pages in 2020, we identified a significant tension in his thought about the Church's contribution to political life.4 Exploring Ratzinger's writings on natural law, we demonstrated that two currents are present. In accord with his fundamental theological commitments about nature and grace and about faith and reason, Ratzinger often questioned the effectiveness of arguments from natural law. He claimed that, since reason is historically conditioned, and therefore in the current order marked by sin, reason needs grace and faith to function properly. Yet, on other occasions, Ratzinger strongly endorsed arguments from natural law, highlighting its role as the foundation of a just democratic political order. We traced this ambivalence about natural law back to a dilemma at the heart of Ratzinger's political thought. On the one hand, in accord with his thinking about the relations of nature and grace and faith and reason, Ratzinger argued that the state needs the Church to supply moral values that the state cannot furnish on its own. On the other hand, he believed it belongs to the very nature of the Church to be separate from the state, and he endorsed nonconfessional, religiously pluralistic states.5 In light of these two commitments, Ratzinger argued that the contribution Christians are to make to the state is to supply moral values that were discerned under the influence of grace and divine revelation but... Virtue ethics has emerged as a distinct field within moral theory - whether as an alternative account of right action or as a conception of normativity which departs entirely from the obligatoriness of morality - and has proved itself invaluable to many aspects of contemporary applied ethics. Virtue ethics now flourishes in philosophy, sociology and theology and its applications extend to law, politics and bioethics. ABSTRACT This symposium brings together commentaries on Serene J. Khader’s Decolonizing Universalism: A Transnational Feminist Ethic from Linda Martín Alcoff, Sunaina Arya, and Olúfẹ'mi O. Táíwò with a reply from Khader. Khader’s book aims to develop a conception of feminism that is both universalist and anti-imperialist. Central to this feminism are (a) the idea that the normative core of feminism is opposition to sexist oppression and (b) the idea that the role of normative concepts in transnational feminist praxis is a (...) justice-enhancing, or nonideal theoretical, one. Khader resists the universalism/relativism framing of debates in global feminisms and argues that opposition to sexist oppression can be detached from the values and social ontology of what she calls ‘Enlightenment liberalism’. She asks whether the values that are most often accused of being vehicles for Western imperialism, namely autonomy, individualism, and gender role eliminativism, are necessary for feminism at all. J.N. Findlay was a South African philosopher who published from the late 1940s into the 1980s. He had a prestigious international academic career, holding many academic posts around the world. This article uses a textual comparative approach and focuses on Findlay’s Gifford Lecture at St Andrews University between 1965 and 1970. The objective of the article is to highlight the extent to which Findlay’s philosophical writings were influenced by Mahāyāna Buddhism. Although predominantly a Platonist, Findlay drew influence from Asian philosophy (...) and religion, particularly Mahāyāna Buddhism. In these lectures, he applies the metaphor of the Platonic Cave to investigate Hegelian and Husserlian approaches to knowledge. Though he was a leading Hegel and Husserl scholar, his reading of these two philosophers is strongly influenced by Mahāyāna Buddhism, resulting in a unique mystical interpretation of these two philosophers. Revisiting Findlay’s writings is significant for two reasons; firstly, he investigated Buddhism prior to the Asian religions being included in Religious Studies departments’ purview in South African universities, and secondly, his interpretation of two prominent Western philosophers along Buddhist lines provides an early attempt at decolonising the predominance of Western philosophical views of knowledge.Contribution: This contribution forms part of a larger collection of essays investigating philosophical works that have had a significant impact on the study of religion. This book was inspired originally by the debates at the turn of the century about placebo controlled trials of antiretrovirals in HIV positive pregnant women in developing countries. Moving forward from this one limited example, the book includes several additional controversial cases of clinical research conducted in developing countries, and asks probing philosophical questions about the ethics of such trials. All clinical research by its very nature uses people to acquire generalizable knowledge to help future people. But what sorts of (...) "use" are morally permissible? What is it to exploit people? Suppose that a trial conducted in a developing country would not be ethically permissible in the developed world. Can we automatically conclude from this that the trial is unethical, that some sort of morally problematic double standard is in operation? Or might the differences in the two settings justify differences in trial design? Zimbabwe's communal farmers are now less food secure than they were two generations ago. The roots of this decline lie not only in the confinement of Africans to marginal land but also in the historic forced replacement of their sustainable, indigenous farming system with one whose productivity now relies on the use of large amounts of expensive chemical inputs. Environmentally-friendly, traditional farming practices such as pyro-culture, minimum tillage, mixed cropping, and bush fallowing were completely wiped out and replaced with a (...) highly technical western or ganic farming system based on plough cultivation and continuous monocultures of commodity crops, that were supposed to be sustained by liberal amounts of green and animal manures. This gave rise to an effective agricultural hegemony that was due, mainly, to the zealous dedication of an American Mormon missionary whose motives were evangelical rather than scientific. (shrink)

Natural moral law stands at the center of Western ethics and jurisprudence and plays a leading role in interreligious dialogue. The socio-economic “pro-democracy” revolutions which are currently sweeping the Soviet Union and Eastern Europe in the name of glasnost and perestroika have virtually stunned all but the best informed in the Western World. The demand for reform throughout the so-called “Soviet block,” and the concomitant impatience with the progress of these changes in the economic and basic social fabric of these societies, have come to exhibit an urgency which few observers, if any, had been able to forecast a few (...) short years ago. The declarations by some members of the U.S. Congress that these changes are indicative of the fact that the cold war has been won by the West, and that we are now witnessing the precipitous collapse of Marxist ideology, together with the widespread sentiment that there is “no going back” to the repressive Leninist-inspired regimes of Stalin, Khruschev, and Brezhniev are all synergistic to the creation of a sentiment of optimism that indeed we have turned the corner in East-West relations. To a world which has lived under the long night of thermonuclear extinction for over four decades, the feeling accompanying the prospect of a possible end to the nightmare of Armageddon further enhances the euphoric sentiment. This study clarifies the confusion concerning the purpose of Husserl's last major phenomenological treatise, Experience and Judgment, and presents his theory of categorical judgment.

The legal framework governing claims of medical negligence is extensively documented within South African (SA) jurisprudence, with a predominant focus on the liability of medical practitioners. In contrast, the liability of pharmacists has received comparatively scant attention. This issue was recently highlighted by a case in which a woman from the Western Cape initiated legal action against Clicks, a leading health, beauty and wellness retailer and SA’s largest retail pharmacy chain, alleging that the provision of incorrect medication nearly cost (...) her life. At the time of writing, the case has yet to advance to trial. This article explores the legal and ethical dimensions of medical negligence attributed to pharmacists within the context of their professional duties. Additionally, it investigates how similar cases are adjudicated in foreign jurisdictions, with a specific focus on the US. (shrink)

On its first appearance in 1960, J.O. Urmson's _Concise encyclopedia of Western philosophy and philosophers_ established itself as a classic. Its contributors included many of the leading philosophers of the English-speaking world: Ryle, Hare, Strawson, Ayer, Dummett, Williams and many others. They wrote with an authority and individuality which made the _Encyclopedia_ into a lively and engaging introduction to philosophy as well as a convenient reference work. For this edition, supervised by Jonathan Rée, the original articles have been revised (...) and updated, and eighty articles by thirty one new authors have been added. The additions take account of recent developments in philosophy, of literary, historical and political issues in philosophy, and of developments in continental thought, including in Marxism, psychoanalysis, phenomenology, existentialism, structuralism, post-structuralism and deconstruction. After all, Aquinas is the most famous medieval thinker in the West, and the question of Church and state is one of the best-known medieval political questions. And yet his thought on that polemical topic remains obscure. As John Watt puts (...) it: "There are too many ambiguities in his doctrine and too many unanswerable questions about what he did or did not hold."1Why is his view not better understood? Part of its obscurity is the relative infrequency with which he writes on politics.2 Another is the relative lack of interest in medieval political thought among political scientists and historians of political thought, an obscurity dating back to the Renaissance.3 Those who do study Aquinas's thought, moreover, have been mired in a controversy over two key texts: one from book II of his Scriptum or commentary on Peter Lombard's Sentences (d. 44, q. 2, a. 3, exp. text.), and the other in book II of De regno (On kingship), chapter 3 (no. 110). For brevity, I will use S for the Scriptum passage and R for the De regno passage.4 These two [End Page 1019] appear to contradict each other, and with respect to fundamental political questions. The debate over these two texts points to what most contributes to the obscurity of Aquinas's teaching on Church and state: confusion about his vision of politics in human life. As I will show in this paper, Aquinas transcends modern categories of the "secular" and "belief" in his treatment of politics. Aquinas valorizes the integrity of political activity: that autonomy is not just a concession to the modern condition. It is in fact when Aquinas is most theological that he is most open to that integrity. The integrity of the political speaks to the intrinsic goodness of that order: it mirrors God's unity in its complex and ordered diversity.In this paper I examine R and S to show their concordance. I argue that they are complementary in what they prescribe for relations between Church and state, and indeed grounded in the same account of the origins of political authority. Through this investigation we will uncover key principles of Aquinas's political thinking that show him to have a capacious vision of politics where humans achieve the actualization of their full beings as human.A key notion will be unitas ordinis, or unity of order: the form of human cooperation in political life. As we will see, that form strikes a middle path between the simple unity of the individual person and the orderless collectivity of a crowd. For Aquinas, that order is itself a common good of politics, and an intrinsic one at that, before any "extrinsic" common good achieved by the people through that order. Part of why this seemingly secular consideration is good is its theological importance: it mirrors God.Further, if Aquinas does not elaborate on political arrangements as much as one would like, nevertheless he offers sure guidance for the principles which ought to guide the prudent development of those arrangements in a particular time and place. Ultimately Aquinas shows that medieval political thought is in key respects not as alien and hostile to us as we might imagine, but in its own way equally concerned about the integrity of the political life.5The Teaching of SAquinas's teaching on Church and state in S is widely accepted as his mature "two powers" teaching.
